The Math Behind It

Termination = Prop. Vacation + 1/3 Bonus + Prop. 13th + FGTS + 40% Penalty + Notice

Termination is calculated by adding: proportional vacation (months worked in the accrual period ÷ 12 × salary), the constitutional 1/3 vacation bonus, proportional 13th salary (months in the year ÷ 12 × salary), FGTS balance (8% × salary × total months), 40% FGTS penalty (only for termination without cause), and proportional notice period.

Example

An employee with a R$ 3,500 salary fired without cause after 3 years would receive approximately: proportional vacation + 1/3, proportional 13th, accumulated FGTS with 40% penalty, and a 39-day notice period.

Frequently Asked Questions

It is a penalty the employer pays when firing without cause. It equals 40% of the total FGTS balance accumulated during the employment contract.
